“Hot News” Has Gone Cold
Anyone distributing news online can rest easier tonight. The Second Circuit held last week that Flyonthewall.com (“Fly”) is not guilty of “hot news” misappropriation for reporting leaked stock recommendations—finding the claim preempted by the Copyright Act.
